Workplace Fitness Challenge 2017

The Promoter – The promoter is Irish Life Health, a company registered in Ireland under No. 376607 with its registered office at Irish Life Centre, Lower Abbey Street, Dublin 1(the "Promoter").The Promoter is solely responsible for running this competition (“Competition”).

The Prizes

There are four prizes available (each a “Prize”, collectively “Prizes”).

  1. Ireland’s Fittest Workplace (“Main Prize”)
    • Presentation of ‘Ireland’s Fittest Company 2017’ Trophy;
    • A wellness programme to the value of €5,000;
    • Spot prizes for Participating Employees.
  2. “Most Improved Large Company Prize”
    • Presentation of "Biggest MET Mover - Large Company" Trophy;
    • A wellness programme to the value of €1,000; 
    • Spot prizes for Participating Employees.
  3. “Most Improved Mid-Sized Company Prize”
    • Presentation of "Biggest MET Mover - Mid-Sized Company" Trophy;
    • A wellness programme to the value of €1,000;
    • Spot prizes for Participating Employees.
  4. “Most Improved Small Company Prize”
    • Presentation of "Biggest MET Mover - Small Company" Trophy;
    • A wellness programme to the value of €1,000; 
    • Spot prizes for Participating Employees.

The Promoter shall have no liability to any Prize Winner in connection with the use or enjoyment of any Prize.

Eligibility Criteria

This competition ("Competition") is open to companies operating within the Republic of Ireland (“Eligible Companies”). The Promoter reserves the right to disqualify any Participant for any reason whatsoever in their sole discretion.

Minimum amount of participants to qualify for the awards:

Large Company Minimum amount of participants: 15

Mid-Sized Company Minimum amount of participants: 10

Small Company Minimum amount of participants: 5

How to Enter

Eligible Companies may enter the Competition by completing the Entry Form available at www.irishlifehealth.ie/moveyourmet/ Eligible Companies must enter the Competition on or before 11:59pm on the 16th May 2017 in order to participate in the Competition. Eligible Companies that do so will be deemed participating companies (“Participating Companies”). Only entries that are made in accordance with these terms and conditions will be eligible to take part in the Competition. The Promoter accepts no responsibility should any company be unable to enter the Competition for any reason. Only one entry per company will be accepted. 

Terms of Participation

Employees of Participating Companies taking part in the Competition (“Participating Employees”) must download the Promoter’s ‘Move Your MET’ App (“the App”) which is available to download via Google Play and the App Store. Employees of Participating Companies must identify themselves as an employee of their respective Participating Company within the App in order to participate in the Competition on behalf of their respective Participating Company. The App calculates a user’s level of fitness which is indicated numerically through an MET score (“MET Score”). Should any employee of a Participating Company fail to register their Company name within the App using their Participating Company’s Company PIN, that employee will not be deemed a Participating Employee.

The Competition will run from the 22nd May 2017 until the 30th June 2017 (“the Competition Period”).

An employee of a Participating Company must register an MET score within the first 12 days of the Competition Period (“Employee Initial MET”) and also within the final 7 days of the Competition Period (“Employee Final MET”) in order to be deemed a Participating Employee. Should any employee of a Participating Company fail to register an Employee Initial Score and an Employee Final Score, that employee will not be deemed a Participating Employee.

Closing Date

The closing date for Competition entries is 11:59pm on Friday 30th June 2017 (“Closing Date”). The Promoter reserves the right to extend the Closing Date. The Promoter accepts no responsibility for any delay or failure in the submission of entries or for any entry which is not received by it before the Closing Date for any reason. Only fully completed entries which are received by the Promoter in accordance with these terms and conditions will be eligible for the Competition. 

Selection of the Prize Winners

There will be four Prize Winners; one for each of the four Prizes.

For the purpose of determining the Prize Winners, the first MET Score of each Participating Employee recorded during the Competition Period will be used in determining the initial average (arithmetic mean) MET Score of that Participating Employee’s respective Participating Company (“Initial Average MET Score”) and the last MET Score of each Participating Employee recorded during the Competition Period will be used in determining the final average (arithmetic mean) MET Score for each Participating Employee’s respective Participating Company (“Final Average MET Score”). For the purpose of determining the Prize Winners, a “Large Participating Company” means a Participating Company with more than 250 employees, a “Mid-Sized Participating Company” means a Participating Company with employees between 51 and 250 in number and a “Small Participating Company” means a Participating Company with fewer than 50 employees.

The winner of the Main Prize will be the Participating Company with the highest Final Average MET Score at the end of the Competition Period. The winner of the Most Improved Large Company Prize will be the Large Participating Company with the greatest positive difference between their Initial Average MET Score and their Final Average MET Score. The winner of the Most Improved Mid-Sized Company Prize will be the Mid-Sized Participating Company with the greatest positive difference between their Initial Average MET Score and their Final Average MET Score. The winner of the Most Improved Small Company Prize will be the Small Participating Company with the greatest positive difference between their Initial Average MET Score and their Final Average MET Score. In order to be eligible to win the Main Prize, a Participating Company must have at least 4 Participating Employees. In order to be eligible to win the Most Improved Large Company Prize, a Large Participating Company must have at least 10 Participating Employees. In order to be eligible to win the Most Improved Mid-Sized Company Prize, a Mid-Sized Participating Company must have at least 8 Participating Employees. In order to be eligible to win the Most Improved Small Company Prize, a Small Participating Company must have at least 4 Participating Employees. The form of spot prizes and the award of same will be entirely at the Promoter’s discretion.

All Participants are deemed to have accepted these terms and conditions by participating in the Competition. The Promoter’s decision is final and the Promoter will not enter into any correspondence with Participants.

The Promoter will contact the Prize Winners by email on or before the 17th July 2017 and arrange the collection of the Prizes with the respective Prize Winners.

Miscellaneous

The Promoter shall not be responsible for any matter arising out of or resulting from the receipt of any Prize. The Promoter cannot accept responsibility for the acts or omissions of third parties including any act or omission resulting in injury arising from taking part in any Prize. The Promoter shall have no liability to the Prize Winners in the event that they are unable to take up the Prize.

To the fullest extent permissible by law, the Promoter shall not be liable to any Entrants or Participants for any loss or damage howsoever caused, whether direct, indirect, or consequential (whether in contract, tort or statutory duty or otherwise other than death or personal injury caused by negligence of the Promoter) arising out of or in connection with the Competition and/or Prize or the taking of the Prize.

The Prizes are non-transferable.

The Promoter reserves the right to amend, withdraw, suspend or terminate this Competition at any time, subject to those restrictions imposed by any applicable law. The Promoter reserves the right to revise the terms and conditions relating to the Competition at any time. The Promoter reserves the right to offer an alternative prize of equal or greater value for any reason or where circumstances dictate.

By entering the Competition, Participants acknowledge that they may be required to participate in publicity for the Promoter without further consent or payment. Such publicity may include but may not be limited to the publication of their name and/or image. The name and county of the Prize Winners will be available for a period of one month after the Closing Date by sending a stamped addressed envelope to the Promoter at the address given above. The name of the Prize Winners may be displayed on the Promoter’s website and Facebook page for a reasonable period of time after the Prize Winners have been selected. The Prize Winners are deemed to have consented to the publication of their personal data in these ways by participating in the Competition.

The following terms which are used in the terms and conditions have the following meaning: the terms “you”, “your” or “Participant” means a person who participates in the Competition under the terms and conditions of the Competition whether as Participating Company or Participating Employee; “Entrant” means an employee of a Participating Company that identifies themselves as an employee and correctly inputs their Participating Company’s Company PIN within the App, whether or not they qualify as a Participating Employee; “Entry Form” is the webpage produced by the Promoter onto which the Participating Company must insert its details in order to enter the Competition and which is available at www.irishlifehealth.ie/moveyourmet/; and “Prize Winner” means the Participating Company that wins the Prize under the terms and conditions of the Competition and “Prize Winners” shall be construed accordingly. 

Data Protection

The Promoter respects the privacy rights of all Entrants and Participants. By submitting your details you are deemed to have consented to the processing of their personal data in line with the Terms and Conditions of the App. In connection with these purposes, the Promoter may share the personal data of Entrants with third parties such as data processors and as required by law.

By participating in the Competition you consent to the processing of your personal data, as described above.

These terms and conditions are exclusively subject to and governed by the laws of Ireland. The Irish Courts shall have exclusive jurisdiction over any claims or disputes arising or in relation to, out of or in connection with these terms and conditions.
